A Failure of Justice - Delivered to Cattleman’s Front Door
Herreid, South Dakota - In spite of the fact that a South Dakota jury awarded cattlemen $9.25 million in a unanimous 2006 jury decision against the major U.S. meatpackers for the misreporting of boxed beef prices, today U.S. Marshals arrived to post a Notice of Levy on the home of plaintiff Herman Schumacher. Herman was one of three named plaintiffs, including Mike Callicrate and Roger Koch, who put their name on the class action case for the benefit of cattle producers. (For more details on the case, please read the press releases that follow.)
Because Herman resides in the State of South Dakota where the case was heard, he was the easiest of the three plaintiffs for Tyson to collect the $15,881.38 from. (The four packers have been awarded $43,301.60 in total court costs.)

Herman has been a champion for cattle producers for many years, often putting his name on the line in what has proven to be futile efforts to restore competition in the cattle markets. He probably didn’t give a second thought to the embarrassing spectacle of U.S. Marshals posting his home in his small community of Herreid, South Dakota. But it seems patently unfair.
This case is not the first time judges have reversed decisions citizen jurors made in favor of cattlemen, creating a disturbing pattern.
A judge also reversed the jury's decision in the earlier Tyson/IBP case, in which cattlemen won an award of $1.28 billion from an Alabama jury convinced that Tyson/IBP had manipulated the cattle markets. After being reversed by the presiding judge, this case finally made its way to the U.S. Supreme Court where the justices refused to hear it in favor of reviewing Anna Nicole Smith's family feud.

Some Courts and Judges obviously need to be held accountable for violating the Constitution as well as the Code of Conduct for Federal Judges.

I know how I'd handle this but most people are not up to that task.
Unfortunately these guys probably voted for McCain and think things like militias are evil and Ron Paul supporters are kooks.
Now they get a first hand look at tyranny. I'd still stand up for them but they are reaping what they and millions of others have sown by supporting this BS system.
Those marshals think they have proper authority to take a mans home because some corrupt judge says so.

Have you considered the fact that the County Sheriff is the most powerful elected official and has the authority to refuse federal intervention?
Sheriff Richard Mack would not allow the Brady Bill to be enforced in AZ, and won. He has a website.
The only problem may be convincing the County Sheriff to stand up to them. Unfortunately, not many sheriffs have the intestinal fortitude that you guys do! I appreciate your commitment to save the ranching industry.

Guys it is worse than that. I was a grower for Tyson, proved that they were cheating farmers to the USDA and Tyson has done the same thing to me only I didn't even get a trial. The judge, who was a fed. prosecutor sent down by Washington D.C. to basically get Tyson off their illegal alien smuggling case in Shelbyville, TN, did that and was then appointed as a federal judge.
When he got my case, which is pretty much already proven by documents from the USDA, the judge dismissed my case, and ruled without a trial, that I had lost. Tyson then went and asked for attorney fees which were awarded to Tyson.
One of Tyson's attorneys was the judges's old law firm where he was a partner before becoming a federal prosecutor. The other was a former law clerk for Supreme Court Justice Alito. Senator Arlen Specter, former head of the Senate Judiciary, and a bunch of corrupt republicans set it up.
We have the best government money can buy and Tyson has the money to buy it. Archie Schafer, who sent the letter to Schumacher, was convicted of bribing the Sec. of Agriculture under Clinton and then Clinton pardoned him.
Arlen Specter got his start with the "meats mafia" by representing the late Frank Perdue who killed one person and wounded another drunk driving. Arlen Specter got him off scott free by having the district attorney not file the case in the statutory time limit and then had the case expunged (erased).
Yes, we have the best judicial system that money can buy. Some of these CEOs and bought off judges need to share a cell with Madoff.
